These Terms of Service ("Terms") govern your use of the websites, AI chat widgets, lead capture forms, SMS notification services, and related technology ("Services") operated by Rook Systems LLC ("Rook Systems," "we," "us," or "our"). By using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
These Terms apply to two types of users: (a) homeowners and consumers ("End Users") who interact with our technology through a Client's website, and (b) home service businesses ("Clients") who subscribe to our lead management platform.
Rook Systems provides AI-powered lead management services for home service businesses. Our Services include: professional websites hosted on behalf of Clients, AI chat widgets that help qualify service requests, lead capture forms, instant SMS and email notifications to Clients when a lead is submitted, an owner dashboard for lead management, and related communication tools.
We act as a technology provider. We are not a party to any service agreement between a Client and an End User. We do not provide home repair services, guarantees about service quality, or warranties on work performed by Clients.
Accurate Information
When you submit a service request through a form or chat widget, you agree to provide accurate and truthful information. Submitting false, misleading, or fraudulent requests is prohibited.
AI Chat Interactions
The chat widget on Client websites is powered by an artificial intelligence system. The AI assistant will identify itself as such. While we strive for accuracy, AI responses may contain errors or incomplete information. Any pricing, availability, or service details provided by the AI are estimates only and must be confirmed directly with the contractor.
No Guarantee of Service
Submitting a lead through our Services does not guarantee that a Client will contact you, provide a quote, or perform services. We facilitate the connection but do not control the Client's response.
The following terms apply to all SMS messaging services operated by Rook Systems on behalf of our Clients.
Program Description
Rook Systems sends automated text messages on behalf of home service businesses to notify homeowners about their service requests, provide follow-up communications, and request reviews after completed service.
Consent
By providing your phone number and affirmatively consenting (e.g., checking a consent box or agreeing via the chat widget), you provide your prior express written consent to receive automated text messages at the phone number you provided. Consent is not required as a condition of purchasing any goods or services.
Message Frequency
You may receive up to 5 automated text messages per service request. Frequency varies based on your interaction. Recurring messages are limited to follow-up communications about your specific service inquiry.
Message & Data Rates
Message and data rates may apply. Check with your mobile carrier for details about your texting plan.
Opt-Out
You may opt out at any time by replying STOP or UNSUBSCRIBE to any message. After opting out, you will receive one confirmation message and no further texts. To resume messages, reply START or submit a new service request with consent.

Supported Carriers
Compatible with all major US carriers including AT&T, Verizon, T-Mobile, US Cellular, Cricket Wireless, Metro by T-Mobile, Boost Mobile, and others. T-Mobile is not liable for delayed or undelivered messages. Carriers are not liable for delayed or undelivered messages.
Privacy
We do not sell, rent, or share your phone number or opt-in information with any third parties for their marketing purposes. Your data is handled in accordance with our Privacy Policy.
Subscription & Billing
Clients subscribe to our Services on a month-to-month basis. There are no long-term contracts. Billing is monthly in advance. Clients may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
Client Responsibilities
Clients are responsible for: responding to leads in a timely manner, providing accurate business information for their website, complying with all applicable laws in their delivery of services to End Users, and maintaining active licensure and insurance as required in their jurisdiction.
Data Ownership
Clients own their lead data. We provide CSV export functionality and will deliver a complete data export upon request. Upon cancellation, Client lead data is retained for 90 days to allow for export, then permanently deleted unless a longer period is required by law.
Acceptable Use
Clients may not use our Services to: send unsolicited bulk messages (spam), collect personal information for purposes unrelated to their home services business, violate any applicable law including TCPA and CAN-SPAM, misrepresent their business or services, or engage in any deceptive, fraudulent, or harmful activity.
The Rook Systems platform, including its software, design, AI systems, templates, and documentation, is the property of Rook Systems LLC and is protected by intellectual property laws. Clients receive a limited, non-exclusive, non-transferable license to use the Services during their subscription period. Client-provided content (logos, photos, business descriptions) remains the property of the Client.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that: our Services will be uninterrupted or error-free, SMS messages will be delivered instantly or at all (delivery depends on carrier networks), AI responses will be accurate or complete, or the use of our Services will result in any particular business outcome for Clients.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOK SYSTEMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM. FOR END USERS WHO HAVE NOT PAID US DIRECTLY, OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
Clients agree to indemnify and hold harmless Rook Systems LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) the Client's use of our Services, (b) the Client's violation of these Terms, (c) the Client's violation of any applicable law, or (d) any dispute between the Client and an End User regarding services performed or not performed.
We may suspend or terminate access to our Services at any time for violation of these Terms, fraudulent or abusive use, non-payment, or at our discretion with reasonable notice. Upon termination, Clients may request export of their lead data within 90 days. After 90 days, data will be permanently deleted except where retention is required by law.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or our Services shall be resolved in the state or federal courts located in San Diego County, California. You agree to submit to the personal jurisdiction of those courts.
We may update these Terms from time to time. For Clients, material changes will be communicated via email or dashboard notification at least 30 days before taking effect. For End Users, changes take effect when posted. The "Last updated" date at the top reflects the most recent revision.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
